When do I have right to compensation with an overbooked flight?
If your flight has been overbooked you are most likely to be entitled to a financial compensation. The exact amount is determined by the flight distance.
How can a flight be overbooked?
Airlines keep in mind that there are almost always passengers who do not show up to their booked flight. By selling more seats than there are in fact available on the aircraft they can earn more money. It is then a speculation for the airline that not more passengers show up than there are seats available. If against expectation more people show up the air carrier is forced to refuse boarding to some passengers. Often they offer a cash amount to wait for the next flight. Even though the offer seems attractive, you may be entitled to more money than they offer.
The European Regulation 261/2004 stipulates that air passengers are entitled to financial compensation when refused entry to an overbooked flight.
You are entitled to the following compensation amounts per passenger:
- €250.00 for flights up to 1,500km
- €400.00 for flights between 1,500 and 3,500km
- €600.00 for flights of more than 3,500km with a delay of 4 hours
There are two further criteria that your flight has to fulfill in order to be eligible for reimbursement. Because it is a European legislation it is important that you flew or departed from the European Union with a European airline. Furthermore the cause of the flight issue has to be the fault of the airline and not be caused by extraordinary circumstances such as political riots, extreme weather conditions or similar that could not have been prevented anyway. So far, we did not have a claim for denied boarding with exceptional circumstances as a cause.
